Syarat & Ketentuan Layanan

1. Agreement

These Terms govern your use of services provided by PT HIT SISTEM INDONESIA (“we”, “our”). By accessing our websites or using our services, you agree to these Terms of Service.

2. Scope of Services

We provide software development, dashboards, automation systems, WhatsApp integration, API development, and social media management. All project details—including scope, pricing, and timelines—are defined in written agreements or proposals.

3. Customer Obligations

  • Provide accurate information and required access to systems.
  • Ensure legal ownership or authorization of data used in the project.
  • Remove WhatsApp application usage when migrating a number to WhatsApp API.
  • Comply with all relevant laws when using our services.

4. Meta & WhatsApp Compliance

For services involving WhatsApp Business API or Meta technologies, the client agrees to comply with:

  • Meta Platform Terms
  • WhatsApp Business Terms
  • WhatsApp Commerce Policy

Violations of platform policy may result in service suspension without refund.

5. Payments & Billing

Fees must be paid according to the invoice or project agreement. We may suspend or delay services if payment is overdue.

6. Intellectual Property

Unless otherwise agreed in writing, source code, internal tools, and proprietary frameworks remain the property of PT HIT SISTEM INDONESIA. Clients receive usage rights for completed deliverables upon full payment.

7. Confidentiality

Both parties agree to keep confidential all non-public information obtained during the project.

8. Limitation of Liability

Our liability is limited to the total amount paid for the services associated with the claim. We are not responsible for indirect, incidental, or consequential damages, including data loss or third-party failures.

9. Termination

Either party may terminate the agreement if a material breach occurs and is not corrected within the specified period. Work completed up to the termination date must still be paid.

10. Governing Law

These Terms are governed by the laws of the Republic of Indonesia.

1. Perjanjian

Syarat ini mengatur penggunaan layanan PT HIT SISTEM INDONESIA (“kami”). Dengan mengakses situs atau menggunakan layanan kami, Anda dianggap telah menyetujui Syarat & Ketentuan ini.

2. Ruang Lingkup Layanan

Kami menyediakan pengembangan perangkat lunak, dashboard, sistem automasi, integrasi WhatsApp, pengembangan API, serta manajemen sosial media. Detail proyek—termasuk ruang lingkup, harga, dan timeline—diatur dalam proposal atau perjanjian tertulis.

3. Kewajiban Pengguna

  • Memberikan informasi dan akses sistem yang akurat.
  • Memastikan kepemilikan atau izin legal atas data yang digunakan.
  • Menghapus penggunaan WhatsApp biasa saat nomor dipindahkan ke WhatsApp API.
  • Mematuhi hukum yang berlaku dalam penggunaan layanan.

4. Kepatuhan Meta & WhatsApp

Untuk layanan yang melibatkan WhatsApp Business API atau produk Meta, pengguna wajib mematuhi:

  • Meta Platform Terms
  • WhatsApp Business Terms
  • WhatsApp Commerce Policy

Pelanggaran terhadap kebijakan platform dapat menyebabkan penghentian layanan tanpa pengembalian biaya.

5. Pembayaran

Pembayaran harus dilakukan sesuai tagihan atau perjanjian proyek. Layanan dapat dihentikan sementara bila pembayaran terlambat.

6. Hak Kekayaan Intelektual

Kode sumber, alat internal, dan framework proprietary adalah milik PT HIT SISTEM INDONESIA kecuali disepakati lain secara tertulis. Hak penggunaan diberikan kepada klien setelah pembayaran penuh.

7. Kerahasiaan

Kedua pihak wajib menjaga kerahasiaan informasi non-publik yang diperoleh selama kerja sama.

8. Batasan Tanggung Jawab

Tanggung jawab kami dibatasi sebesar total biaya layanan terkait. Kami tidak bertanggung jawab atas kerugian tidak langsung, termasuk kehilangan data atau kegagalan pihak ketiga.

9. Penghentian

Kedua pihak dapat mengakhiri perjanjian apabila terjadi pelanggaran material yang tidak diperbaiki. Pekerjaan yang telah diselesaikan tetap harus dibayar.

10. Hukum yang Berlaku

Syarat ini diatur oleh hukum Republik Indonesia.
